Regardless, I imagine this guy could claim abandonment. In big urban areas grocery stores have to block off the cart area to keep people from walking off with them (no, really!) In spite of that, there were several in a deep gulley near our first apartment. Big rains would wash them away, only to see them replaced with "new" ones.
